Terms of Service

These Terms of Service outline the conditions under which we provide container storage and related services. By booking a container, storing goods at our facility, or using any of our services, you agree to be bound by these terms. Please read them carefully before you use our services.

Services Provided

Sam’s Yard offers container storage (20ft, 40ft, 40ft High Cube & 45ft High Cube), container handling, heavy-duty lifting, container sales, vehicle storage, and related yard services. All services are subject to availability and operational requirements.

To rent a storage container you must sign the storage agreement and adhere to our terms of service.

  • Storage Agreement: This agreement and contract is legally binding for all storage containers rented from us. (Term 1)
  • Address Usage: You are not permitted to use the site address as your business address. (Term 13)
  • Transfer of Services: You must not transfer rented containers to any third party. All charges remain the responsibility of the agreement holder, and new customers must sign their own contracts. (Term 25)

Storage Terms

Storage is payable on a weekly basis. Customers may remove their goods at any time, and no advance notice is required unless otherwise agreed. A refundable deposit is required when renting the storage and will be returned once the container and it's surroundings are deemed empty and clean.

  • Right to Move: We reserve the right to move storage containers from their original position to another without prior notice. Fragile/breakable goods must be reported to management before entry. (Term 12)
  • Container Access/Inspection: Management reserves the right to open and search containers without notice if rent is in arrears, if illegal activity is suspected, or if you are a police suspect. Information may be shared with authorities (Police, Customs, HMRC, DVLA, or EA). We are not liable for damage during searches. (Term 14)
  • Vacating: Containers should be vacated the day before the rental expiry date. (Term 17)
  • Fast-Track Storage: The maximum period allowed in "Fast-Track" containers is 28 days. Every day thereafter is charged at £100 per day. (Term 20)
  • Disposal Rights: If rent is not extended within 14 days of expiry, we reserve the right to offload and dispose of goods. A flat-rate offload cost of £400 plus accrued rent and legal/collection fees will apply. (Term 21)

Customer Responsibilities

Customers are responsible for ensuring that all goods are properly packed, secured, and suitable for storage or shipment. All items stored must be lawful and accurately declared. Hazardous, illegal, or restricted materials must not be stored unless approved in writing.

  • Prohibited Goods: You are strictly prohibited from storing expensive antiques, explosives/firearms, hazardous/toxic materials, pollutants, unlawful/stolen goods, perishable items, waste products, illegal drugs, or tyres (unless a £500 deposit is provided). (Term 2)
  • Refuse and Litter: No items or refuse may be left outside storage units except in provided bins. A minimum fine of £60 per day applies for unauthorized items left on site. (Term 11)
  • Contact Information: You must notify us immediately if you change your address, phone number, or travel outside the UK. (Term 23)

The Customer agrees to:

  • Keep the premises clean and free from rubbish
  • Not deposit waste or materials anywhere on site
  • Immediately notify the Company if they change address or telephone number
  • Inform the Company if they intend to travel outside the United Kingdom while a vehicle remains on site

Access and Loading

Containers or vehicles may be positioned on the ground for loading, subject to operational scheduling. Customers must complete loading within the agreed timeframe and follow all on-site safety instructions.

  • Unauthorized Storage: Storing items without consent will incur a minimum fine of £300 or expulsion from the premises. (Term 18)
  • Access Denial: If rent falls into arrears, access will be denied and the container locked without notice. A £10 fee is required to regain access. (Term 19)
  • Site Removal: We reserve the right to remove any customer from the premises without notice for non-payment, suspected unlawful activity, or fighting/quarrelling in the yard. (Term 26)
  • Banning Policy: If you are banned from the site, rent will continue to accrue until all items are removed. (Term 27)

Equipment and Handling

Sam’s Yard uses professional heavy-lifting equipment, including reach stackers, forklifts, and cranes, operated by trained personnel to ensure safe and efficient handling of containers and goods.

Liability and Insurance

Goods stored at Sam’s Yard remain the customer’s responsibility. Customers are strongly advised to arrange appropriate insurance for items stored or handled on site. Sam’s Yard’s liability is limited to the extent permitted by law.

  • Insurance Requirement: You must ensure all goods/vehicles have adequate insurance cover against fire, water, theft, or damage. (Term 3a)
  • Container Damage: You are liable for the full cost of repairs for any damage caused to the storage container. (Term 6)
  • Claims: In the event of loss or theft, you must contact your own insurers for claims. (Term 7)
  • Payment Processing: All charges incurred by us for credit card payments will be passed on to the customer. (Term 22)

Environmental Compliance

Sam’s Yard operates in accordance with Environment Agency requirements and is authorised to carry out WEE testing, refurbishing, reuse, and certification on site.

  • Fluid Drainage: All vehicles/goods must be fully drained of fluids before entering the yard to prevent contamination. (Term 3c)
  • Prohibited Pollutants: Storage of pollutants or contaminated goods is strictly forbidden. (Term 2e)

Health and Safety

All visitors must follow site safety instructions at all times. Sam’s Yard reserves the right to restrict access or suspend activities where safety procedures are not followed.

  • PPE Requirements: High-visibility clothing must be worn by everyone on site. Failure to do so incurs a £25 fine. Hard hats are required for anyone performing loading tasks in the yard. (Term 4)
  • Loading Safety: All loading must comply with Health & Safety Regulations. We are not liable for loss or injury to you, your agents, or third parties. Customers carrying out loading or unloading must also wear:
  • Hard hats
  • Safety boots

All persons entering the premises do so at their own risk. All loading and unloading activities must comply with applicable UK health and safety legislation.

The Company shall not be liable for any injury or damage suffered by the Customer or any third party unless caused directly by the proven negligence of the Company.

Financial Terms

  • Price Changes: Costs are subject to change with seven days’ written notice. (Term 1)
  • Payments & Deposits: A minimum of four weeks’ rent and a four-week refundable deposit are due in advance. Fines may be deducted from the deposit. Deposits are refunded only if the unit is left clean and tidy. (Term 15)
  • Extensions: The minimum payment for extending rent is one week, due before the current period expires. (Term 16, 17)
  • Arrears & Late Fees: Late payment (by 7 days) will incur a £10 late fee. Rent must be paid before using facilities. (Term 18, 19)

Vehicle Storage

Untaxed vehicles may be stored securely within the yard prior to shipment. Customers are responsible for ensuring all vehicle documentation is accurate and compliant with relevant regulations.

  • Vehicle Requirements: Vehicles stored on-site must have proof of ownership submitted to management and must be fully drained of all fluids before entry. (Term 3b, 3c)
  • Unlawful Parking: Vehicles parked unlawfully will be impounded and subject to a £100 fine plus £20 per day storage costs. (Term 9)
  • Parking Liability: We accept no responsibility for damage to vehicles parked in the yard; we advise storing vehicles inside containers. (Term 10)
  • The Customer must not store or transport goods inside vehicles parked within the yard.
  • Under no circumstances may goods with a total value exceeding £2,500 be stored within any vehicle or storage area on the premises.
  • The Company reserves the right to refuse or remove vehicles suspected of containing prohibited or unsafe goods.

Vehicle Parking

By parking a vehicle at Sam’s Yard, the Customer confirms that they have read, understood, and agreed to be legally bound by these Terms and Conditions. If the Customer does not agree with these Terms and Conditions, they must not park a vehicle on the premises.

Use of the Premises

2.1 Vehicles may only be parked in areas designated by the Company.

2.2 Vehicles must not remain on the premises for longer than 7 days unless prior written permission is granted by the Company.

2.3 The Company reserves the right to relocate or remove vehicles if necessary for operational, safety, or security reasons.

2.4 Keys for all vehicles parked overnight must be deposited with the Company office unless otherwise agreed.

2.5 Any vehicle left overnight without submitting keys, or parked in a manner that obstructs operations or other customers, will incur:

  • £100 penalty charge
  • £200 penalty if parked in a designated loading bay
  • £20 per day parking charge

Vehicle Insurance Requirements

The Customer must ensure that all vehicles stored on the premises are adequately insured against:

  • Fire
  • Flood or water damage
  • Theft
  • Vandalism
  • Accidental damage

The Company does not provide insurance cover for vehicles or their contents.

In the event of loss, theft, or damage, the Customer must claim through their own insurance provider.

Vehicle Liability

The Company shall not be liable for loss, theft, damage, deterioration, or destruction of any vehicle or its contents while on the premises, except where caused by the Company’s negligence.

6.2 The Company accepts no responsibility for damage caused by other customers, contractors, weather conditions, fire, flooding, vandalism, or third parties.

6.3 The Customer agrees to indemnify and hold harmless the Company against any claims, losses, damages, or liabilities arising from the Customer’s use of the premises.

6.4 Nothing in these Terms shall exclude liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be excluded under UK law

Non-Payment, Misconduct, and Removal

The Company reserves the right to remove or terminate the Customer’s use of the premises without notice if:

  • Rent remains unpaid
  • The Customer is suspected of unlawful activity
  • The Customer engages in disputes, quarrels, or fighting within the premises

The Company may remove vehicles to another location within or outside the premises if necessary to protect operations or prevent obstruction.

Abandoned Vehicles

Vehicles left on the premises beyond the agreed storage period may be deemed abandoned.

The Company reserves the right to remove, relocate, or dispose of abandoned vehicles in accordance with applicable UK law to recover outstanding costs.

The Customer will remain liable for all associated costs, including storage, removal, and administrative fees.

Contractual & Personal Data

Data Protection: You consent to us storing your personal/company data. We will not share data with third parties except for debt collection or legal reasons. You may request data removal in writing after vacating. (Term 24)

Changes to Terms

Sam’s Yard reserves the right to update these Terms of Service at any time. Continued use of our services constitutes acceptance of the latest version.
